Abstract In recent years, the facts of violation of the procedural independence of prosecutors during the conduct of their procedural direction in pre-trial investigation have spread. Contrary to the principle of publicity provided by Art. 25 of the Criminal Procedural Code of Ukraine, in criminal proceedings there are circumstances that prevent the prosecutor from taking all the measures envisaged by law to establish the event of the criminal offense and the person who committed it. This is explained, in particular, by the fact that in legal theory the problem of ensuring the procedural independence of a prosecutor in criminal proceedings is not sufficiently developed.
The purpose of the article is to report on legal sanctions, enforcement and responsibility as special means of ensuring the procedural autonomy of a prosecutor at the stage of pre-trial investigation in criminal proceedings.
The main results of the study are that based on the analysis of the prosecutor’s powers to supervise the observance of due cource of law during the pre-trial investigation in the form of procedural direction, scientific views on their universal nature and the legal nature of the procedural independence of the subjects of legal relations at the stage of pre-trial investigation that the exercise of procedural autonomy of the prosecutor during the conduct of procedural direction by the pre-trial investigation limits only initiative of its powers. The article describes the characteristics of legal sanctions, procedural enforcement and legal responsibility as guarantees for the protection of the procedural independence of the prosecutor at the stage of pre-trial investigation in criminal proceedings. The purpose of these guarantees and the essence of such basic methods of influence as conviction and enforcement, which are used to ensure the procedural autonomy of the prosecutor during the administrating of the procedural direction at pre-trial investigation, are highlighted. It is noted that the legal nature of enforcement in criminal proceedings is not limited to acts, actions and measures during which physical force is used. The criteria for the admissibility of the use of physical influence during the exercising of individual investigative (search) actions.
According to the results of the study, it is proposed to amend the Criminal Procedural Code of Ukraine and the Code of Ukraine on Administrative Offenses with the aim of improving the national legislation and strengthening the protection of the procedural independence of the prosecutor at the stage of pre-trial investigation in criminal proceedings.
